Overhead and Profit is a term that insurance companies like to avoid as much as possible.  The mere mention of it to your agent is liable to send them sidestepping for a politically correct and often confusing answer.  There is a tremendous amount of confusion, deception and litigation over these words.  What does this mean to you, the insured?  Without your insurance company including Overhead and Profit as part of your claim settlement, you will then be responsible for either trying to cut corners and make repairs yourself or you will have to cover this expense out of your own pocket.  Even though many of the state’s insurance boards have issued interpretations of how insurance companies are to handle it, many are still reluctant to include it as part of their claim settlement.  Some have even tried to access a depreciation loss to it, as if labor and cost of new material can actually depreciate before it’s even purchased.

The Texas Department of Insurance issued a Commissioner’s Bulletin on June 12, 1998.  It was earmarked to the attention of all property and casualty insurance companies.  Here is the closing excerpt “The Department has concluded that an insurer providing property coverage under replacement cost residential policies that allow for the adjustment of covered losses to structures on an actual cash value basis may not calculate actual cash value on the basis of replacement cost with proper deduction for depreciation, less contractor´s overhead and profit, nor may the insurer deduct sales tax on building materials. Any insurer that determines actual cash value on this basis may be subject to disciplinary action for violations of the Texas Insurance Code, including unfair claims practices pursuant to Article 21.21 § 4(10)(a) and Article 21.21-2.”

In an effort to help educate the residents of Oklahoma, launched its latest radio campaign. Beginning last Saturday and running through Christmas, the radio airwaves of Oklahoma City will hear two different spots, the first is a 30 second spot explaining the great things that we have accomplished for Oklahoma residents. We have already helped and processed over $500,000 in claims just in Oklahoma. It appears that there are several companies in Oklahoma who pride themselves on not paying their claims properly and is here to help you.

The second commercial is a 15 second spot promoting our newest website, This website was built and designed with the consumer in mind. This is a place that you can share your voice with the world. It’s your forum to explain what you went through with your insurance company. We have designed this site on a WordPress Blog format so that consumers will have the ability to submit their stories. Whether their damage was from Storm, Fire or Flood Damage, we want to hear your side of the story. We also give you the option as to how you want your name listed with your story, you can select from using your first name, last initial or full name or anonymously, the choice is yours.

After a complete study of the first 100 cases, Cal Spoon has confirmed his suspicions, the Insurance companies either denied or underpaid or both, on 99% of all claims. The Insurance companies offered approximately $375,000.00, to date has recovered over $2 million, and are still processing over $2 million. This is very real and it affects 99 out 100. After spending the last few weeks contacting clients about sharing their stories on our other site,, I have noticed a very common theme with regards to the problems with their insurance companies.  The insurance companies like to say NO…..

These are the same insurance companies that will let you pay and pay your premiums all the while knowing that if you file a claim, they are going to do their best not to pay you what you deserve.  One man that I spoke to said that he’d been paying his premiums since 1984 and he actually had to call his insurance company three times just to get them to send out someone to look at the damage that was caused by two tornadoes. Then when they finally did come out, he was told that they would only pay for one side of his house.  When he protested, they agreed on two maybe three, but the fourth side would have to be filed as a separate claim.  After filing the claim for the remaining side, his insurance company then increased his rates almost double from what they had been because, you ready for this, he filed two claims within a 12 month time frame.  They didn’t tell him that would happen when they advised him to file the second claim for the remaining side of his house.

Stories like this are repeated over and over.  When it comes to filing a claim with your insurance company, they are going to do whatever they can to say NO and discourage you.  Whether it’s the entire claim or just a majority of the claim, they want and will say NO.  They don’t care how long you have been a client, loyalty means nothing.  This is where insurance companies have become experts in the industry, working claims.  They hire professionals whose sole purpose is to work your claim down and keep their profits up.

It is amazing at how many people that I talk to that tell me they don’t trust their insurance company.  They continue to pay the premiums hoping that they never have to file a claim.  I had one gentleman tell that reason he felt this way is that he knew that his insurance company would not pay him what he felt he would rightfully deserve.  It shouldn’t be that way, but that is how the insurance business model is built.

The typical insurance company wants to maintain a loss ratio as low as possible, this makes them more profitable.  What do I mean by loss ratio? Here’s a simple example, say that an insurance company has 100 clients that each pay $1000 per year for their homeowners policy.  This would equal $100,000 in premiums for that year.  Then one of the policy holders files a claim for $100,000.  This leaves zero profits and a 100% loss ratio.  Therefore insurance company’s take the steps needed to maintain at least a low loss ratio in order to keep profits up and who do you think suffers when these practices are put in place, you do, whether it’s through higher premiums or claims that have been reduced by the insurance companies.  Click here to see Homeowners Insurance Loss Data for Texas.

This past Saturday was a special day, one filled with happiness, joy and long lasting memories as Melanie and Cal confessed their love and exchanged their wedding vows for each other. Although I have only known them for a short time, you can see that their love is the type that only comes along once in a lifetime and they’re blessed to have been able to find it. With that said, I would like to offer the following the toast to happy couple…

To the Melanie and Cal whose love for each other has brought all together. May you always know happiness, joy, peace, understanding, respect, devotion, fidelity, faith, goodness, kindness and love. Well the weekend has arrived. It’s been a great week here at, we’ve seen the official launch of our community program, Bustin4Relief. This is a program that is very dear and near to the hearts of each the team members here. It’s our way of giving back to communities that are in need of assistance with regards to putting things back in order. Which brings me to my topic today, the power behind, Cal Spoon and Melanie Cospelich.

I have now been with the company for almost two months and what I have witnessed has been an amazing effort put forth by these two people. As they prepare to exchange their vows of love to each other later this month, their commitment and passion for their family, their business as well as the community is incredible. They have a complete understanding of the laws and what is fair for their clients. They work very hard to get what is fair for them. They also believe in raising their children with the correct morals so that they too can grow up and become productive members of society. Because of them, this is an exceptional company to work for and I look forward to long and lasting relationship as we all move forward towards our goals together.

Let me start with Cal, it’s hard to find all the right words to describe this man, but I’ll do my best. This has got to be one of the hardest working individuals that I have ever met. He is on the road constantly working with and fighting for our clients. Whether is meeting with clients, inspectors or contractors, he’s there waiting for them. He does his best to make sure that each and every client is represented honestly and fairly to each of their insurance companies. I’ve had the opportunity to see firsthand his tenacity when talking to the insurance companies. He’s relentless at getting what he feels the clients should be receiving in order to put themselves whole again. It starts from the very first time that he meets with them at their home. Instead of just making a few notes and walking away, he does a complete and thorough inspection of the damage. His construction background gives him the knowledge to know what to look for and what the results of a flood, tornado, hurricane or hail storm can do to a home. He also takes the time to get to know our clients, how they feel about their loss and what their intentions are as far as rebuilding. I feel strongly that it is this passion that one day will make Cal a leader in his field. Now for Melanie. Wow has to be the best work to describe her. I know the insurance companies have got to tired of her. Her follow up and attention to detail is by far some of the best I have ever seen. Her office is close enough to mine so that I can hear her making her follow ups to the insurance companies. Her resolve is relentless and follow up is constant. She has a knack for getting the right person on the phone and will not hang up until she does. You can actually tell that the person on the other end has got to be rolling their eyes when they answer their phone as Melanie introduces herself as being from There have been times that I just have to laugh at the people on the other end of the phone. When these people review the claims submitted by us, they know that they are complete and in order so it’s now time to make good on their proper coverage. I have heard times where the other person apparently has asked for something else in the claim, Melanie politely informs them that if they’ll simply look at the what was faxed to them on a certain date, that they’ll find said paperwork. (another rep rolling their eyes). Simply put, we are very lucky to have Melanie on our side.

In closing, let me just say that if you have never used a public adjuster before or maybe you have had some trepidation about doing so. Here is how I see it. The adjuster that your insurance company sends out works for the insurance company. Now if you look at it from a business stand point, the insurance company is in business to make a profit, so therefore this doesn’t really promote fairness for you. With that said, a public adjuster is licensed by the state that they work in to represent the claim holder, aside from lawyers and the broker of record. Simply put, the public adjuster works for you and they do everything they can to make bringing your home back to the way it was before a disaster. Making you whole again. No, they can’t make it the same, nobody can. Disasters will be a part of life and as much as no one likes it, it’s the reason we all continue to pay the premiums. It’s one of those things that you continue to pay in hopes that you never have to use it. However, with what I have seen so far, Cal and Melanie are definitely two people that I would want I my side when filing a claim.
